Local Media San Diego, LLC, its subsidiaries and affiliated companies (together, the “Company”), will conduct the Contest substantially as described in these rules, and by participating, each participant agrees as follows.

How Winner is Chosen: The successful caller will win a $125 Disney gift card, and be a finalist to win the grand prize, following confirmation of eligibility.

How Winner is Chosen: On September 20 and 27, one contestant will be selected on at random from successful entries received to win a $125 Disney gift card, and be a finalist to win the grand prize, following confirmation of eligibility.
Grand Prize Selection: One finalist will be randomly selected to win the Grand Prize Vacation Package.

- Prize(s):
(12) $125 Disney gift cards and finalist positions will be given away on-air and the on-line sweepstakes.
(1) Grand prize Vacation package will be awarded. Grand Prize Vacation Package to include: Roundtrip coach airfare for four (4) to Honolulu, a voucher for four (4) roundtrip ground transfers between the Honolulu International Airport and the Resort, Room accommodations of one (1) standard room (with a maximum of four (4) person per room) for four (4) consecutive nights at the Resort, and $200 Resort Credit. Winning package must be taken before 12/15/2023 (certain travel restrictions do apply, based on availability.) Approximate retail value of Vacation Package is $6,715.00
Winners are strongly advised to seek professional legal, tax advice. Award of the Prize could have material adverse consequences on the winner including without limitation, with respect to taxes, income, government entitlements or other benefits, or other legal, financial or other matters.
Prizes are not transferable or exchangeable for any other prize, and must be accepted in whole. If a winner cannot be contacted or is disqualified, the Company reserves the right to determine an alternate winner or not to award that winner’s prize, in its sole discretion.
- Eligibility and Limitations.
Participants, contestants and winner(s) must be U.S. residents of San Diego County, at least 18-years old as determined by the Company, have an active social security number, and be able to present California ID to contest officials before the prize is awarded, as well as the original social security card if needed.
Employees of the Company, the Contest’s participating sponsors and their advertising agencies, employees of other radio or television stations, and members of the immediate family of any such persons are not eligible to participate and win. The term “immediate family” includes spouses, siblings, parents, children, grandparents, and grandchildren, whether as “in-laws,” or by current or past marriage(s), remarriage(s), adoption, co-habitation or other family extension, and any other persons residing at the same household whether or not related.
- Taxes.
Any valuation of the prize(s) stated above is based on available information provided to the Company, and the value of any prize awarded to a winner may be reported for tax purposes as required by law. Each winner is solely responsible for reporting and paying any and all applicable taxes, including the vehicle sales tax and registration. Each winner must provide the Company with valid identification and a valid taxpayer identification number or social security number before any prize will be awarded. Prizes are not transferable, redeemable for cash or exchangeable for any other prize unless otherwise noted. Any person winning over $600 in prizes from a station will receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS. Winner agrees to accept the prize “as is.” - Publicity; Use of Personal Information.
By participating, all participants and winner(s) grant the Company exclusive permission to use their names, characters, photographs, voices, and likenesses in connection with promotion of this and other contests and waive any claims to royalty, right, or remuneration for such use. By participating in the Contest, participants agree that the Company may disclose personal information obtained from participants in the Contest to third parties and use such information for marketing and other purposes. - Affidavit.
Winners may be required to sign and return an Affidavit of Eligibility, Release of Publicity, and Release of Liability upon notification of winning. Failure to sign and return the affidavit and release within such period or to comply with any term or condition of these Official Rules may result in disqualification and forfeiture of any interest in a prize. - Release.
By participating, each participant and winner waives any and all claims of liability against the Company, its employees and agents, the Contest’s sponsors and their respective employees and agents, for any personal injury or loss which may occur from the conduct of, or participation in, the Contest, or from the use of any prize. In order to receive a prize, participants must sign an official waiver form provided by the Company.
The company assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries. The company is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line-systems, servers or providers, computer equipment, software, failure of email, technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to participants or to any person’s computer or data related to or resulting from participating or downloading materials in this Web site or Contest. The company is not responsible for cheating or fraud by any entrants. Any activities intended to disrupt or interfere with the proper play of the Contest, or to defraud the Sponsor in any way, may be prosecuted to the fullest extent of the law. Participants engaging in any of the foregoing activities will be disqualified and will forfeit any prizes won. If, for any reason, the Contest is not capable of operating as planned, including, without limitation, as a result of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the reasonable control of the company which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, the company reserves the right at their sole discretion to cancel, terminate, modify or suspend the Contest and award prizes among eligible entries received.
- Decisions.
By participating in the Contest, participants agree to be bound by the decisions of Company personnel. The Company reserves the right to disqualify any participant or winner and may refuse to award any prize to a person who is ineligible or who the Company believes has violated any rule, gained unfair advantage in participating in the Contest, or obtained winner status using fraudulent means. The Company will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Contest and the Company’s decisions concerning such disputes shall be final. If the conduct or outcome of the Contest is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of the Company, the Company reserves the right to terminate this Contest, or make such other decisions regarding the outcome as the Company deems appropriate. All decisions will be made by the Company and are final. The Company may waive any of these rules in its sole discretion. - Miscellaneous.
Each winner must submit proof of eligibility and sign the Company’s release form to claim the prize. No purchase necessary to participate or win. Purchase does not increase chance of winning. Void where prohibited. Odds of winning depend upon the number of participants. The Company may substitute prizes, amend the rules or discontinue the Contest at any time as announced on the Station(s). The Company disclaims any responsibility to notify participants of any aspect related to the conduct of the Contest. Written copies of these rules are available during normal business hours at the business offices of the Station(s) and by mail upon written request with a stamped, self-addressed return envelope.
Travel and lodging for the Vacation Package awarded by Promoter must be completed prior to December 15, 2023. The winner and up to three (3) guests (each a “Guest”; collectively “Guests” and together with the winner the “Group”) must travel together on the same itinerary, and air transportation must be round-trip from/to the same Departure Airport / Arrival Airport, as chosen by Disney.
“Departure Airport” is the major United States gateway airport closest to winner’s residence, and “Arrival Airport” is Honolulu International airport, with possible layovers, as chosen by Disney. Airport, airline carrier and flights to be selected by Disney in its sole and absolute discretion.
Vacation Package fulfillment and travel are subject to certain restrictions, air travel/flight availability, and certain hotel/room availability at the Premises. The Vacation Package must be booked through a travel agent as designated by Disney at least forty-five (45) days prior to arrival. Block-out dates apply. No extensions will be granted. Certain travel and lodging restrictions apply including airline carrier’s regulations and conditions. Airline tickets are non-refundable, non-transferable, and are not valid for upgrades. Promoter and Disney are not liable for any expenses incurred as a consequence of flight cancellation/delay.
Winners must be at least the age of majority pursuant to his/her applicable state of residence to enter and win. A Guest under the age of majority must be accompanied by his/her parent/legal guardian who must be at least the age of majority and both will be deemed Guests of the winner (unless the winner is the Guest’s parent or legal guardian). Once selected by winner, Guests cannot be changed without the express written consent of Disney, which may be withheld for any reason.
Vacation Package and its components may not be used in conjunction with any other promotion or offer, separated, sold, exchanged or redeemed for cash, traded, transferred, substituted, assigned, or rescheduled to dates other than as set forth above, except in Disney’s sole and absolute discretion.
The Vacation Package will not include the following: transportation from/to winner’s residence to/from Departure Airport, transportation to/from the Premises if winner resides on the island of Oahu, airport departure fees, baggage fees; insurance (health, travel, medical); parking fees (unless stated otherwise); room service, laundry service, spa treatments; food or beverages; merchandise, souvenirs; incidental expenses; local or long distance telephone calls; tips, gratuities, service charges; or any taxes; or any other charges not explicitly included herein.
All elements of the Vacation Package must be used by the Group on the same dates during the redemption of the Vacation Package. Any portion of the Vacation Package not accepted or used by winner will be forfeited.
Entertainment and other elements of the Vacation Package may be seasonal and subject to change without notice.
A winner may not charge any Guest for participating in the prize. Prizes are awarded “as is” with no warranty or guarantee, expressed or implied, being provided by Promoter or Disney.
The winner and his/her Guests are responsible for having valid travel documents including government-issued identification and/or passports, as applicable.
The winner will not receive compensation for any element(s) of the Vacation Package that any participant(s) is unable to use for any reason, and such unused portion(s) of the Vacation Package will be forfeited.
If the winner chooses to bring less than the allotted number of Guests, the Vacation Package will be awarded in increments suitable for the actual number of participants with no substitute prize or compensation provided to the winner.
The winner and his/her Guests will be required to execute a liability/publicity/COVID-19 release and waiver form prior to booking of any travel. Failure to return the executed release form within the specified time period will result in forfeiture of the Vacation Package. Winner acknowledges that he/she is solely responsible for any actions, claims or liabilities of the Group, related to any use or misuse of the prize or any prize-related activity or travel.
Any damaged, lost or stolen travel vouchers or gift cards will not be replaced. Gift cards are not redeemable or exchangeable for cash (except as required by law) and are subject to all terms and conditions of use as established by issuer.
There may be specific instructions and requirements for all visitors to Hawaii, which may include mandated quarantine or pre-travel testing. The winner and his/her Guests are solely responsible at their own cost for staying updated on and complying with any of the latest advisories, restrictions and travel alerts that may be in place for travel to Hawaii leading up to the planned stay. State requirements are subject to change.
The actual value of the Vacation Package may vary depending on point of departure and fluctuations of hotel rates and airfares. Any difference between the approximate retail value and the actual cost of the/each Vacation Package will not be awarded.
Federal, state and local taxes relating to the prize are the responsibility of the winner and Promoter will issue all tax forms including a 1099 form to the winner.
Promoter is the sponsor of the sweepstakes.
Disney, its parent, related, affiliated and subsidiary entities and their respective officers, directors, agents, employees and assigns will be released and discharged from any and all legal claims, losses, injuries, demands, damages, actions, and/or causes of actions that arise out of and/or are in any way related to the prize, the receipt, use and/or enjoyment of the prize, or prize-related activity including travel, the Promotion or the Sweepstakes.
All disputes arising out of or relating to any prize provided by Disney shall be resolved by applying the laws of California, without regard to conflict of law rules, and shall be solely and exclusively brought in state or federal courts within Orange County, California. Such claims shall be resolved individually, without resort to any form of class action, and all such claims shall be limited to actual out-of-pocket costs incurred, but in no event to include attorneys’ fees.
In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Sweepstakes promotional materials and the terms and conditions of the Official Rules, the Official Rules shall prevail and govern.
- Winner’s List.
For a Winner’s List, available thirty (30) days following the end of the Contest Period, send a self-addressed, stamped envelope to: Local Media San Diego, Attn: MAGIC 92.5 Disneyland Aulani Winners 2022, 6160 Cornerstone Court East, Suite 150, San Diego, CA 92121. Please include the following in your Winner’s List request: Your full legal name, name of station and indicate which winner’s list you would like to receive. Please include one self-addressed, outer postmarked envelope for every list requested. - Compliance with Law.
The conduct of the Contest is governed by the applicable laws of the Unites States of America, which take precedence over any rule to the contrary herein. Station(s) shall follow the applicable laws for conducting contests, including notice to the state attorney general or consumer affairs office, posting of a prize bond, furnishing lists of winners, running specific on-air disclaimers, providing specific written information about the Contest, etc. as required by local and state law.
