Magic 92.5 (XHRM-FM 92.5) “Disneyland Giveaway” Official Sweepstakes Rules

MAGIC 92.5 (XHTZ-FM) & LOCAL MEDIA SAN DIEGO, LLC ARE NOT RESPONSIBLE FOR ANY EVENT / PRIZE CHANGES AND / OR CANCELLATIONS.

General sweepstakes contest rules may be picked up at 6160 Cornerstone Court East, Suite 150, San Diego, CA 92121, Monday – Friday during normal business hours.

Local Media San Diego, LLC, its subsidiaries and affiliated companies (together, the “Company”), will conduct the Sweepstakes substantially as described in these rules, and by participating, each participant agrees as follows:

1. Description of Contest Sweepstakes / Participation

A. Dates of Sweepstakes: January 30, 2020 to March 20, 2020.

NO PURCHASE NECESSARY. PURCHASE DOES NOT INCREASE ODDS OF WINNING. Void where prohibited. Odds of winning depend upon the number of participants.

B. How to Play: Listen for the designated cue to call, Monday through Friday, once per hour from 10:00 AM to 2:59 PM and be the indicated caller to 619-570-1925.  One prize will be given away per hour, for a total of five prizes per day, one of which will be the Grand Prize.  Prize will be announced at the time of giveaway.

ALL DECISIONS MADE BY JUDGES ARE FINAL.

2. Prize(s).

Daily prizes will be announced at time of giveaway.

Daily Grand Prize is four 1-Day, 1-Park tickets to Disneyland Resort.  ARV: $596.00

The Grand Prize winner is strongly advised to seek professional legal, tax advice. Award of the Grand Prize could have material adverse consequences on the Grand Prize winner including without limitation, with respect to taxes, income, government entitlements or other benefits, or other legal, financial or other matters.

Prizes are not transferable or exchangeable for any other prize, and must be accepted in whole. If a winner cannot be contacted or is disqualified, the Company reserves the right to determine an alternate winner or not to award that winner’s prize, in its sole discretion.

3. Eligibility and Limitations.
Participants, contestants and winner(s) must be U.S. residents of San Diego County, at least 18-years old as determined by the Company, have an active U.S. Passport for travel, have an active social security number, and be able to present the original social security card and California ID to contest officials before the prize is awarded.

Only one (1) prize per household. Employees of the Company, the Sweepstakes’ participating sponsors and their advertising agencies, employees of other radio or television stations, and members of the immediate family of any such persons are not eligible to participate and win. The term “immediate family” includes spouses, siblings, parents, children, grandparents, and grandchildren, whether as “in-laws,” or by current or past marriage(s), remarriage(s), adoption, co-habitation or other family extension, and any other persons residing at the same household whether or not related.

4. Taxes.
Any valuation of the prize(s) stated above is based on available information provided to the Company, and the value of any prize awarded to a winner may be reported for tax purposes as required by law. Each winner is solely responsible for reporting and paying any and all applicable taxes, including the vehicle sales tax and registration. Each winner must provide the Company with valid identification and a valid taxpayer identification number or social security number before any prize will be awarded. Prizes are not transferable, redeemable for cash or exchangeable for any other prize unless otherwise noted. Any person winning over $600 in prizes from a station will receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS. Winner agrees to accept the prize “as is.”

5. Publicity; Use of Personal Information.
By participating, all participants and winner(s) grant the Company exclusive permission to use their names, characters, photographs, voices, and likenesses in connection with promotion of this and other contests and waive any claims to royalty, right, or remuneration for such use. By participating in the Sweepstakes, participants agree that the Company may disclose personal information obtained from participants in the Sweepstakes to third parties and use such information for marketing and other purposes.

6. Affidavit.
Winners may be required to sign and return an Affidavit of Eligibility, Release of Publicity, and Release of Liability upon notification of winning. Failure to sign and return the affidavit and release within such period or to comply with any term or condition of these Official Rules may result in disqualification and forfeiture of any interest in a prize.

7. Release.
By participating, each participant and winner waives any and all claims of liability against the Company, its employees and agents, the Sweepstakes’ sponsors and their respective employees and agents, for any personal injury or loss which may occur from the conduct of, or participation in, the Sweepstakes, or from the use of any prize. In order to receive a prize, participants must sign an official waiver form provided by the Company.

The company assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries. The company is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line-systems, servers or providers, computer equipment, software, failure of email, technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to participants or to any person’s computer or data related to or resulting from participating or downloading materials in this Web site or Sweepstakes. The company is not responsible for cheating or fraud by any entrants. Any activities intended to disrupt or interfere with the proper play of the Sweepstakes, or to defraud the Sponsor in any way, may be prosecuted to the fullest extent of the law. Participants engaging in any of the foregoing activities will be disqualified and will forfeit any prizes won. If, for any reason, the Sweepstakes is not capable of operating as planned, including, without limitation, as a result of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the reasonable control of the company which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, the company reserves the right at their sole discretion to cancel, terminate, modify or suspend the Sweepstakes and award prizes among eligible entries received.

8. Decisions.
By participating in the Sweepstakes, participants agree to be bound by the decisions of Company personnel. The Company reserves the right to disqualify any participant or winner and may refuse to award any prize to a person who is ineligible or who the Company believes has violated any rule, gained unfair advantage in participating in the Sweepstakes, or obtained winner status using fraudulent means. The Company will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Sweepstakes and the Company’s decisions concerning such disputes shall be final. If the conduct or outcome of the Sweepstakes is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of the Company, the Company reserves the right to terminate this Sweepstakes, or make such other decisions regarding the outcome as the Company deems appropriate. All decisions will be made by the Company and are final. The Company may waive any of these rules in its sole discretion.

9. Miscellaneous.
Each winner must submit proof of eligibility and sign the Company’s release form to claim the prize. No purchase necessary to participate or win. Purchase does not increase chance of winning. Void where prohibited. Odds of winning depend upon the number of participants. The Company may substitute prizes, amend the rules or discontinue the Sweepstakes at any time as announced on the Station(s). The Company disclaims any responsibility to notify participants of any aspect related to the conduct of the Sweepstakes. Written copies of these rules are available during normal business hours at the business offices of the Station(s) and by mail upon written request with a stamped, self-addressed return envelope.

Theme park attractions and entertainment may be seasonal and subject to change without notice.

Theme park tickets must be used prior to December 15, 2020. Terms and conditions as set forth herein and on the theme park tickets shall apply.

A winner may not charge any Guest for participating in the prize. Prizes are awarded “as is” with no warranty or guarantee, expressed or implied, being provided by the Station or Disney.

Any damaged, lost or stolen theme park tickets, will not be replaced.

The Station is the sponsor of the Sweepstakes.

Disney, its parent, related, affiliated and subsidiary entities and their respective officers, directors, agents, employees and assigns will be released and discharged from any and all legal claims, losses, injuries, demands, damages, actions, and/or causes of actions that arise out of and/or are in any way related to the prize, the receipt, use and/or enjoyment of the prize, or prize-related activity including travel, the Promotion or the Sweepstakes.

In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Sweepstakes promotional materials and the terms and conditions of the Official Rules, the Official Rules shall prevail and govern.

All prizes awarded must be picked up at the Station’s studios at 6160 Cornerstone Court East, Suite 150 San Diego, CA 92121 during normal business hours of 9:00 a.m. to 5:00 p.m., Monday through Friday, unless otherwise specifically directed by Station. Prizes will not be mailed, unless otherwise determined by the Station.

Prizes not claimed within thirty (30) business days of being advised by Station that the prize is available for pick-up, or in the case of a time sensitive prize, within its period of usability if shorter than 30 business days, shall be considered forfeited (without notice to the winner) and will become property of Station. Such prize may be disposed of at the discretion of Station Management.

Prizes will be released to winners only. Winners may be required to present a valid United States state or federal photo ID and valid social security number in order to pick up any prize. Winners may be required, in Station’s sole discretion, to sign one or more liability release agreements relieving the Station, its parents, subsidiaries, officers, directors, members, managers, employees, agents, Sweepstakes sponsors and others from any and all liability with respect to the contestant’s participation in the contest and the receipt and/or use of the prize. Any person who refuses to sign the Release and/or provide a social security number or complete or provide any other documents required by the Station by the deadline required by Station will forfeit any and all prizes.

Winners are prohibited from selling any prize awarded or transferring any prize without Station’s authorization (which authorization must be in writing by a Station representative and shall be granted or withheld in Station’s sole discretion on a case by case basis). In the event that Station discovers or suspects (correctly or incorrectly) that a winner is attempting to sell his/her prize from Station (i.e., ebay, craigslist or otherwise), Station reserves the right, in its sole discretion, on a case by case basis to take any one or more of the following actions: (a) immediately disqualify the winner and deem any prize they were otherwise entitled to as forfeited, (b) refuse to award the prize to such winner, even if he/she represents that they will not resell or transfer the prize, and/or (c) prohibit the violating winner from participating and/or winning any future Station contests (whether for a fixed period of time or in perpetuity, in Station’s sole discretion) and if such winner ever wins a future Station Sweepstakes during the period that he/she is banned, he/she shall be disqualified from the Sweepstakes and forfeit any prize once it has come to Station’s attention. Further, Station reserves the right to track and/or cancel and invalidate any prize awarded that Station suspects was sold or transferred without authorization.

10. Winner’s List.
For a Winner’s List, available thirty (30) days following the end of the Sweepstakes Period, send a self-addressed, stamped envelope to: Local Media San Diego, Attn: Magic 92.5 Disneyland Spring Winners, 6160 Cornerstone Court, East, Suite 150, San Diego, CA 92121. Please include the following in your Winner’s List request: Your full legal name, name of station and indicate which winner’s list you would like to receive. Please include one self-addressed, outer postmarked envelope for every list requested.

11. Compliance with Law.
The conduct of the Sweepstakes is governed by the applicable laws of the Unites States of America, which take precedence over any rule to the contrary herein. Station(s) shall follow the applicable laws for conducting contests, including notice to the state attorney general or consumer affairs office, posting of a prize bond, furnishing lists of winners, running specific on-air disclaimers, providing specific written information about the Sweepstakes, etc. as required by local and state law.

All disputes arising out of or relating to any prize provided by Disney shall be resolved by applying the laws of California, without regard to conflict of law rules, and shall be solely and exclusively brought in state or federal courts within Orange County, California. Such claims shall be resolved individually, without resort to any form of class action, and all such claims shall be limited to actual out-of-pocket costs incurred, but in no event to include attorneys’ fees.
